AN ACT to authorize certain highways to be laid out less than four rods wide.

AN ACT to amend section thirty-three, chapter ore hundred and nine, of the revised statutes of eighteen hundred and forty-six, being section forty-six hundred and forty-eight of compiled laws, relative to partition of lands owned by several persons.

SECTION 1. The People of the State of Michigan enact, That section thirty-three, of chapter one hundred and nine, of the revised statutes, be amended so as to read as follows:

If the commissioner to whom reference shall be made, as hereinbefore provided, shall report to the court that all the lands or tenements of which division and partition is sought, are so situated, or that any district, tract, lot or portion thereof, is so situated that a partition and division thereof amongst the persons interested therein cannot be made without great prejudice to the owners, and if the court shall be satisfied that such report is just and correct, the court may thereupon make an order that the commissioner sell the premises so situated, at public aution, to the highest bidder; and if said commissioner shall report that any portion, interest or part can

Discharge of treasurer and sureties

Sec. 55. AN ACT to incorporate the city of Coldwater.

SECTION 1. The People of the State of Michigan enact, That ity limits. sections fifteen, sixteen, all that portion of section seventeen lying east of Coldwater river, all that part of the north half of section twenty lying east of the river and lake, and all of sections twenty-one and twenty-two, of township six south of range six west, being the township of Coldwater, Branch county, be and the same are hereby set off from said township, and declared to be a city by the name of the city of Coldwater, by which name it shall be hereafter known.

The freemen of said city, from time to time, being inhabitants thereof, shall be and continue a body corporate and politic, to be known and distinguished by the name and title of the city of Coldwater, and shall be and are hereby made capable of suing and being sued, of pleading and being impleaded, of answering and being answered unto, and of defending and being defended, in all courts of law and equity, and in all other Common places whatever; and shall have a common seal, which they may alter and change at pleasure, and by the same name shall be and are hereby made capable of purchasing and holding, conveying and disposing of any real or personal estate for said city.
