SEC. 2674. Any person who has heretofore, by any act of the general assembly of this State, has been accorded a pension for services ren- Descriptions dered the State or the United States in the years A. D. eighteen hundred and fifteen, and known as veterans of those years, or their widows, shall be entitled to the benefit of this act; and the amount appropriated by this act as a pension for such persons shall be paid on their own warrant, when the signature to such warrant is attested by a certificate of the clerk of the court of the parish in which such pensioner resides, that he saw the pensioner sign the warrant, and that he is the person he represents himself to be, which warrant shall be accompanied by the affidavit of the pensioner that he is the person to whom the law has heretofore awarded a pension, which law, by its date and number of the act, shall be referred to in said affidavit.

SEC. 2675. Every person shall be entitled to the benefit of this act who shall make oath that he was regularly in the military service of Statement unthe United States or of this State in the years A. D. eighteen hundred and fourteen and A. D. eighteen hundred and fifteen, and in that capacity, at the siege of New Orleans, in December, A. D. eighteen hundred and fourteen, and January, A. D. eighteen hundred and fifteen, and is now residing in this State; who shall state in such affidavit the company, regiment or other army divisions of which he was a member at that time, and that he was honorably discharged afterwards from the service; and, in addition, such persons shall have either evidence of his having been in the military service of the country, as above reviewed, and of his honorable discharge, or the evidence of two credible witnesses, who have been acquainted with him for at least ten years, that he has borne the reputation of having been a veteran of eighteen hundred and fourteen and eighteen hundred and fifteen, as above defined, and the certificate of the clerk of the district court of the parish of his residence to the credibility of the applicant' and his witnesses;

and the pension provided by this act shall, on the presentation of such evidence as is required by this section, be paid on the warrant of the pensiorer.

SEC. 2676. The pension provided by this act shall take effect and commence from the first day of September, A. D. eighteen hundred and sixty-eight.

SEC. 2677. No person shall be allowed to practice medicine as a means of livelihood in any of its departments in the State of Louisiana without first making affidavit, before a duly qualified justice of the peace in the parish wherein he resides, of his having received the degree of doctor of medicine from a regularly incorporated medical institution in America or Europe, and designating its name and locality.

SEC. 2678. SEC. 2679. Any practitioner failing to comply with the requirement of section twenty-six hundred and seventy-seven of this act shall Penalty for violating this act. not be permitted to collect any fees or charges for services rendered by legal process, and moreover shall be liable to a penalty of twenty dollars for each and every violation thereof, said sum or sums to be collected by indictment or information, as in other cases provided by law.

SEC. 2680. One-half of the fines imposed under this act shall be paid to the prosecutor and the remainder into the parish treasury. SEC. 2681. The provisions of this act relative to physicians shall not apply to persons who have been practicing medicine for the space of ten years in this State without diplomas, nor to female practitioners of midwifery as such.

PILOTS.

Sec. 2686, 2687 and 2688 are superseded by Act No. 99 cf session 1880, p. 126, which reads as follows:

No. 99. An act to regulate the system of pilotage of the ports of the State, to define the qualifications of pilots, and to define the duties of the board of examiners, and to provide for the appointment of pilots.

SEC. 1. It shall be the duty of the board of examiners to report to the Duty of board governor any and all vacancies occurring by death, resignation or other- of examiners. wise in the number of pilots of the State, and also to call a meeting of the board of examiners for the examination of applicants to fill such vacancy. SEC. 2. No person shall hereafter be appointed a pilot for the e trauce

of the Mississippi river unless he be a duly qualified elector of the State of Qualifications Louisiana, and shall have actually served in a pilot boat at the mouth of to be pilot. the Mississippi river for the space of at least twelve months next preceding the date of his application, and shall have been recommended to the governor of the State by the board of examiners as being duly qualified as a branch pilot for the port of New Orleans.

SEC. 3. Every branch pilot, in order to entitle him to act as such, shall Bond. give bond to the State, with two sufficient sureties, residents in New Orleans, in the sum of two thousand dollars, subject to the approval of the master and wardens of the port of New Orleans.

SEC. 4. If any outgoing vessel shall carry off to sea, through the fault of the moster or owner of such vessel, any pilot, when a boat is attending to Penalty. receive him, the masters and owners of such vessel shall pay, besides the pilotage to the pilot the same monthly wages during the passage of such vessel as the chief mate is receiving, and said master or owner shall likewise pay said pilot's passage home on the first vessel clearing for this port or for the nearest port convenient to it.

SEC. 5. SEC. 6. The governor shall appoint as pilots for the entrance of the Cal- Pilots for encasieu river, and other entrances, ports or passes on the seacoast of the trance of Cal. State which are not already provided by existing laws, such number of casieu river. duly qualified, persons recommended by the boards of examiners, as the interest of the commerce of such ports may require, who shall be subject to existing laws as far as applicable to such ports or passes.

signal or otherwise, he shall be suspended from his duties as pilot for the term of five years, and shall, moreover, be liable to be fined in the sum of three hundred dollars; in default of payment thereof he shall suffer imprisonment for the term of three months.

SEC. 2690. The master or owner of any ship or vessel, appearing in distress and in want of a pilot on the coast, shall pay unto any such branch pilot who shall have exerted himself for the preservation of such ship or vessel, such sum for extra service as the said owner or master and pilot can agree upon, provided said pilot boards said ship or vessel off pilot ground. In case no such agreement can be made the master and wardens, or any three of them, shall determine what is a reasonable reward which the pilot shall be entitled to collect. D. sec. 2235.

SEC. 2691. Any commissioners and members of the board of examiners neglecting or refusing to perform their duties as such may, upon written complaint and statement, signed by an absolute majority of the duly commissioned branch pilots of their causes of complaint, be removed from said office of commissioner, or dismissed, and their places filled by the governor.

SEC. 2692. If any vessel outward bound shall carry off to sea, through the default of the master or owner of such vessel, any pilot, when a boat is attending to receive him, shall pay, besides the pilotage, the pilot the same monthly wages during the passage of such vessel as the chief mate is receiving; and said master or owners shall likewise pay said pilot's passage home on the first vessel clearing for this port or convenient to it.

SEC. 2693. It shall be the duty of a pilot, when going on board of any outward bound ship or vessel at the boarding stations, to remain on board of such ship or vessel until she crosses the bar, unless permission is given by the master for said pilot to absent himself from said ship or vessel.

SEC. 2694. Pilot boats, when cruising, shall be required to exhibit from sunset to sunrise, from the foremast head, a bright white light, visible all round the horizon for a distance of five miles, and exhibit a flare-up light on deck, midships, every fifteen minutes. They shall also exhibit, from sunrise to sunset, a bluepeter from the main topmast head; this shall not apply to any boats that have boarded out all their pilots. All pilot boats at the mouth of the Mississippi river shall cruise seaward on a radius of five nautical miles from the sev eral entrances to said river.

SEC. 2695. No pilot shall board any inward bound vessel for the purpose of piloting such in except from the pilot boats on their sta- Boarding of tions. Any pilot boarding an inward bound vessel in a small boat from the shore, not belonging or attached to the pilot boats, for the purpose of piloting such vessel in, shall be subject to a fine of one hundred dollars, to be sued for by the master and wardens, by a civil process, before any court of competent jurisdiction; and said fine, when collected, shall be paid to the charity hospital of New Orleans, for its use and benefit.

SEC. 2696. No branch pilot shall be allowed to leave his station for more than three consecutive days, unless he shall have obtained a written permission from the board of examiners, under a penalty of fifty dollars. Permission shall in no case be granted to more than two branch pilots to leave their station at the same time.

SEC. 2697. Every person offering to pilot a ship or other vessel shall, if required, exhibit to the commander of the ship or vessel his Pilots to exlicense as branch pilot; and upon his refusing or neglecting to do so license. when demanded he shall not be entitled to any remuneration for any service he may render as pilot.

Neglect of

SEC. 2698. It shall be the duty of the board of examiners of the port of New Orleans to report to the governor any neglect of duty, pilots. drunkenness, carelessness, habitual intemperance, incompetency or general bad conduct on the part of any branch pilot, showing that said branch pilot ought to be removed or suspended; and it shall be the duty of the governor, if, upon due inquiry, such report be well founded, to revoke or suspend the commission of said branch pilot. D. sec. 1587; Act 1865, p. 162.

Sec. 2699. The master of any vessel having cause to complain of the misconduct of any pilot whilst on duty on board of said vessel, Complaint, when made by may go before the master and wardens of the port of New Orleans, a captain of a and, on statement made upon oath of the cause of his complaint, it shall be the duty of said master and wardens to forthwith transmit a copy of the same to the governor, who, if he deems it proper, shall cause a thorough investigation to be had of the causes of complaint by the board of examiners; and, upon revision, approval or rejection of their award, the governor may either acquit, remove or suspend the pilot so accused.
