and be applicable to the provisions of this Act: And pro

2 vided further, That amendment to the Food and Drugs Act,

section 10A, approved June 22, 1934 August 27, 1935 (U. S. C., 1934 ed., Sup. 1, title 21, sec. 14a), shall

remain in force and effect and be applicable to the provi

6 sions of this Act: And provided further, That nothing

in this Act shall impair or be construed to impair or

8 diminish the powers of the Federal Trade Commission

under existing law.

(b) The provisions of this Act shall not be held to 11 modify or repeal any of the existing laws of the United States except as provided by paragraph (a) of this section. (c) Meats and meat food products shall be exempt from the provisions of this Act to the extent of the applica

tion or the extension thereto of the Meat Inspection Act, 16 approved March 4, 1907 1907, as amended (U. S. C., 17 1934 ed., title 21, secs. 71-93 91; 34 Stat. 1260 et seq.); as amended.

AN ACT

To prevent the adulteration, misbranding, and false advertising of food, drugs, devices, and cosmetics in interstate, foreign, and other commerce subject to the jurisdiction of the United States, for the purposes of safeguarding the public health, preventing deceit upon the purchasing public, and for other

purposes.

Be it enacted by the Senate and House of Representatives of the United States of America in Congress assembled,

CHAPTER I

SECTION 1. That this Act may be eited as the "Federal

5 Food, Drugs, and Cosmetic Aet.”

CHAPTER H

DEFINITION OF TERMS

SECTION 201. As used in this Act, unless the context

4 otherwise indicates

5

(a) The term "food" includes all substances and prep

6 arations used for, or entering into the composition of, food,

7 drink, confectionery, chewing gum, or condiment for man or other animals.

(b) The term "drugs", for the purposes of this Act and not for the regulation of the legalized practice of the 11 healing art, includes (1) all substances and preparations ree12 ognized in the United States Pharmacopeia, Homeopathie 13 Pharmacoperis of the United States, or National Formulary,

or any supplement to any of them; and (2) all substances 15 and preparations intended for use in the diagnosis, eure, 16 mitigation, treatment, or prevention of disease in man or other animals; and (3) all substances, and preparations, 18 other than food and cosmeties, intended to affect the structure

or any function of the body.

(e) The term "device", for the purposes of this Aet

in diagnosis, cure, mitigation, treatment, or prevention of 24 disease in man or other animals; and (2) to affect the

(d) The term "cosmetic" includes all substances and 2 preparations, except soaps or household cleansers for which 3 no medicinal or curative qualities are claimed by the manu4 facturers or retailers in labels or advertisements, intended 5 for cleansing, or altering the appearance of, or promoting 6 the attractiveness of, the person.

(e) The term "Territory" means any Territory or 8 possession of the United States, including the District of Columbia and excluding the Canal Zone.

The term "interstate commerce" means (1) commerce between any State or Territory and any place

outside thereof, and (2) commerce or manufacture within 13 the District of Columbia or within any other Territory not 14 organized with a legislative body.

(g) The term "person" includes individual, partner

16 ship, corporation, and association.

(h) The term "Secretary" means the Secretary of

18 Agriculture.

(i) The term "label" means the principal display or displays of written, printed, or graphie matter (1) upon 21 any food, drug, device, or cosmetic, or the immediate con

22

tainer thereof, and (2) upon the outside container or 23 wrapper, if any there be, of the retail package of any food,

24 drug, device, or cosmetic.
