Statement.

This action was begun by the service of a summons and complaint on February 21st, 1906. The defendant duly appeared and served its answer on March 16th, 1906. The plaintiff served an amended complaint on April 2nd, 1906, and issue was joined by the service of the defendant's answer to the amended complaint on April 22nd, 1906. There has been no change of parties or attorneys. The names of the original parties in full are as above set forth. Hobart S. Bird, Esquire, was and still is the attorney for the plaintiff, and William Greenough, Esquire, was and still is the attorney for the defendant.

Sirs:

Please take notice that the above named plaintiff, Luigi Onesti, hereby appeals to the Appellate Division of the Supreme Court for the Second Department from the judgment of this court, entered herein in the office of the Clerk of the County of Orange on or about the 11th day of January, 1908, whereby it was adjudged that the complaint of the plaintiff in this action be dismissed, and that the defendant recover from said plaintiff the sum of $170 costs, and have execution therefor, and from the order entered herein on the 15th day of January, 1908, denying the plaintiff's motion for a new trial on the minutes, and from each and every part of said judgment 8 and order.
