printed on the ballots of those voting at such election, and if at such election it shall appear that a majority of the votes cast in any one precinct shall be for such proposition, "for suspension," then the operation of such law shall be suspended within the limits of said precinct, at the expiration of twenty days from the official canvass of the vote in said precinct.

SEC. 11. Nothing herein contained shall be so construed as to prevent any owners of cultivated lands or fruit or forest trees from maintaining an action for all damages caused by stock which has escaped or been driven away from the premises thus damaged, against the owner of the stock causing such damage.

SEC. 12. All acts and parts of acts inconsistent and in conflict with this act shall be, and are hereby repealed. SEC. 13. This act shall take effect and be in force f and after the first day of April, a. D. 1875.

Vacating certain surveys of the town of Sutton.

Be it enacted by the Legislature of the State of Nebraska:

SECTION 1. That the plat of the survey of the town of Sutton, in Clay county, Nebraska, made by John R. Patrick, and recorded in the county clerk's office of said Clay county, on the 20th day of December, A. D. 1872, be and the same is hereby vacated.

Be it enacted by the Legislature of the State of Nebraska:

SECTION 1. That the provisions of an act entitled “An law extended to act for a general herd law to protect cultivated lands from trespass by stock,” approved, March 8, 1871, are hereby extended and made to 'apply to Knox county, Nebraska.

AN ACT

To locate a state road from Creighton, in Knox county, Nebraska, by way of Walnut Grove in the same county, and Baders to Troy in Holt county.

Be it enacted by the Legislature of the State of Nebraska :

SECTION 1. That Hiram Carman, Watson Sawyer, of Holt county, and Henry Grim, of Knox county, be, and are hereby appointed commissioners to locate a state road, beginning at Creighton, in Knox county, thence to Walnut Grove, in the same county; thence in a northwesterly direction by way of Baders to Troy, in Holt county.

SEC. 2. That said commissioners or any two of them, shall meet in Niobrara on the first day of June, A. D. 1875, or within thirty days thereafter, and after taking and subscribing to an oath or affirmation before the county clerk, to faithfully discharge their duties, which oath or affirmation shall be filed in the office of said county clerk, they shall then proceed to locate said road.

SEC. 3. The said commissioners shall have power to employ one competent surveyor, and the necessary assistants and teams. The commissioners shall receive three
