Third ward. All that part of said city bounded northerly by the city bounds, easterly by the westerly line of the second ward, southerly by the center of Union street, and westerly by the westerly line of the New York Central and Hudson River railroad.

Fourth ward. All that part of said city bounded northerly by the center of Union street, easterly by the center of Nott terrace, southerly by the center of State street, and westerly by the westerly line of the New York Central and Hudson River railroad.

Fifth ward. All that part of said city bounded northerly by the center of State street, easterly and southerly by a line commencing at a point where the center line of Veeder avenue produced northeasterly intersects the center line of State street, and running thence southwesterly along said line and along the center line of Veeder avenue to the point of intersection of the center line of Veeder avenue with the center line of South Center street, and thence westerly along the center of South Center street to the westerly boundary line of said city as formerly established by a map filed in the office of the county clerk of Schenectady county on the twentyfifth day of January, eighteen hundred and sixty-six; and westerly by the city bounds as formerly established by a map filed in the office of the county clerk of Schenectady county on the twenty-fifth day of January, eighteen hundred and sixty-six, and the westerly line of the New York Central and Hudson River railroad.

Sixth ward. All that part of said city bounded northerly by the center of Union street and the center of the Troy turnpike, easterly by the city bounds, southerly by the center of the Albany turnpike, and the center of State street, and westerly. by the center of Nott terrace.

Seventh ward. All that part of said city bounded northerly by the center of State street, easterly and southerly by a line commencing at a point where the center line of Steuben street produced northeasterly intersects the center line of State street, and running thense southwesterly along said line and along the center line of Steuben street and said center line produced southwesterly to the center of Duane avenue, thence westerly along the center of Duane avenue to the center of Craig street, thence southerly along the center of Craig street and along the center line of Craig street produced southerly to the southerly boundary line of said city as formerly established by a map filed in the office of the county clerk of Schenectady county on the twenty-fifth day of January, eighteen hundred and sixty-six; and westerly by the city bounds as formerly

established by a map filed in the office of the county clerk of Schenectady county on the twenty-fifth day of January eighteen hundred and sixty-six, and the fifth ward.

Eighth ward. All that part of said city bounded northerly by the center of State street and the center of the Albany turnpike; easterly by the city bounds and southerly by the city bounds, as formerly established by a map filed in the office of the county clerk of Schenectady county on the twenty-fifth day of January, eighteen hundred and sixty-six, and westerly by the seventh ward.

Ninth ward. All that part of said city bounded easterly by the fifth, seventh and eighth wards, southerly, westerly and northerly by the westerly line of the New York Central and Hudson River railroad.

Tenth ward. All that part of said city bounded northerly by the center line of the Erie canal, easterly by the first and ninth wards, southerly and westerly by the city bounds.

The term city bounds used in this section as descriptive of ward boundaries, except where otherwise specified, refers to the bounds of the city of Schenectady as enlarged by inclusion therein of portions of the towns of Rotterdam and Niskayuna.

§ 4. Corporate name and powers.-The inhabitants within the boundaries of the city of Schenectady, as aforesaid, shall be a munícipal corporation by the name of the city of Schenectady. Said corporation may sue and be sued, complain and defend in any court; use the present public seal of said city as its common seal, and alter it at pleasure; and may receive, by gift, grant, bequest, devise or purchase, and hold and convey such real and personal estate as the purposes of the corporation may require.

§ 5. Official and fiscal year. The official and fiscal year of the city shall, except as otherwise provided in this act, commence on the first day of January in each year.

§ 10. City officers. The officers of the city shall be a mayor; a recorder; a treasurer; a comptroller; a city judge; a police justice; three assessors; one supervisor and two aldermen for each ward; a commissioner of public works; a commissioner of public safety; a corporation counsel; a city clerk; six members of the board of health; a city engineer; a city marshal, who shall be janitor of the city hall; an overseer of the poor; a city physician; a sealer of weights and measures; thirty commissioners of deeds; ten commissioners of common schools; and such other boards and officers as are hereinafter provided for.

§ 11. Manner of choosing city officers.- Except as herein otherwise provided, the city officers shall be chosen as follows: The mayor, recorder, treasurer, comptroller, city judge, police justice and assessor shall be elected by ballot by the qualified electors of said city; the supervisor and aldermen for each ward shall be elected by ballot by the qualified electors of each ward. The commissioner of public works, commissioner of public safety, corporation counsel, city clerk, city engineer, city marshal, overseer of the poor, city physician, and sealer of weights and measures, and commissioners of deeds, shall be appointed by the common council at its annual meeting in each even numbered year, by a majority vote and by ballot, unless the council shall, by unanimous vote of those present, otherwise order. The members of the board of health shall be appointed by the common council upon the nomination of the mayor, in the manner and

for the terms prescribed by article two of the public health law. The commissioners of common schools shall be appointed by the mayor, and each such appointee shall be of the same political faith as his predecessor. All appointments to city offices made as prescribed in this act shall be evidenced by a certificate in writing, signed by the appointing officer, and filed forthwith in the office of the city clerk. If an appointment be made by the common council, such certificate shall be signed by the officer presiding at the time the appointment was made, and attested by the city clerk. All other officers and city employes shall le elected or appointed as hereinafter provided.

§ 12. Terms of office. The term of office of the officers specified in the preceding section shall be two years, except that a full term of the city judge and of the police justice shall be four years, and of an assessor and of a member of the board of health shall be three years. The tern of office of each elective officer, except supervisor, shall commence with the first day of January succeeding his election. The term of office of a supervisor shall commence with the second Tuesday of April succeeding his election. The term of office of each officer appointed by the mayor or common council for a full term shall com nence on the day succeeding his appointment. The term of office of the commissioners of common schools shall commence with the first day of March. One supervisor for each ward shall be elected every two years and one alderman for each ward shall be elected each year. Two members of the board of health and five commissioners of common schools shall be appointed each year. § 13. Eligibility.- No person shall be eligible to a city office in said city unless at the time of his election or appointment he is a resident elector of said city, and, if elected by a ward of said city, unless at the time of his election he is also a resident of the ward for which he shall be elected. If a city officer shall cease to be a resident of the city, his office shall thereupon become vacant. A corporation counsel hereafter chosen shall have been admitted to practice in this state as an attorney at law for five years. A police justice or city judge, hereafter chosen, shall have been admitted to practice in this state as an attorney at law. A city engineer hereafter chosen shall be a civil engineer of at least five years practical experience in his profession. An alderman hereafter elected in any ward shall have been a resident in such ward for at least five months prior to his election. No person shall, at the same time, hold more than one city office, except that this provision does not apply to the office of commissioner of deeds.

§ 14. City elections. A general city election shall be held annually on the Tuesday next succeeding the first Monday of November, at the time and at the places fixed for holding the general election. Such election shall be conducted, and the votes cast thereat canvassed and the returns thereof made, in the manner provided by the election law. The board of county canvassers for the county of Schenectady shall, forthwith upon the completion of the canvass, cause the certificate of the determination of the election of any officer of the city of Schenectady to be filed in the clerk's office of such city. There shall be elected at each general city election successors to all elective city and ward officers whose terms will expire before the date of the next city election.

§ 15. Notice to persons elected or appointed. The city clerk shall give notice, in writing, to every person elected or appointed to any office under this act of his election or appointment, within twentyfour hours after the certificate of his election or appointment has been filed in his office, which notice shall be served personally or by leaving it at the residence of such person.

§ 16. Official oaths.- Every city officer shall, before he enters upon the duties of his office, take and file his official oath in accordance with article thirteen of the constitution and section ten of the public officers law, and for an omission so to do, he shall be subject to the liabilities and penalties prescribed by section forty-two of the penal code, and sections thirteen, fifteen and twenty of the public officers law.

§ 17. Official bonds. In addition to the officers required to give bonds, by this act, the common council may require any other officer or person appointed under the provisions of this act, to give an official bond, with such sureties as it may approve, conditioned as it may direct; and it may, whenever it may be proper, require additional or further security of any officer or person after the giving of the bond first required. Except as otherwise provided by law, no person elected or appointed to any office under the provisions of this act shall enter upon the discharge of his duties until the bond, if any, required to be given by him shall have been approved and filed in the office of the city clerk, or otherwise filed as required in this act.

§ 18. Compensation of city officers and employes.- The annual salary of the mayor shall be two thousand dollars; of the recorder, five hundred dollars; of the treasurer, seventeen hundred and fifty dollars; of the comptroller, seventeen hundred and fifty dollars; of the city judge, fifteen hundred dollars; of the police justice, fifteen
