This cause to be continued until after the next regular session of the legislature, and if not ratified by the legislature at its next regular session, then to stand for trial as if this stipulation had not been entered into.

And whereas, It is deemed by the legislature of the State of Nebraska advantageous to the public interest that the said settlement and stipulation be fully ratified and confirmed.

Now, therefore,

Be it enacted by the Legislature of the State of Nebraska:

SECTION 1. That the said settlement so stipulated to be made, be and the same is, in all things, ratified and Brock ratified confirmed, and the bond and mortgage, given pursuant to said stipulation, and deposited escrow with S. B. Pound, of Lincoln, Nebraska, be and the same are hereby accepted, and are hereby directed to be filed as part of the securities for the investment of the permanent school fund of the State of Nebraska.

To authorize the treasurer of Platte county to refund certain taxes.

Be it enacted by the Legislature of the State of Nebraska:

SECTION 1. That the treasurer of Platte county, Nebras- Treasurer of ka, is hereby authorized and required to refund to the taxpayers of said county the amount of tax by them paid for one thousand eight hundred and seventy-four, in excess of the amount authorized to be levied and collected by law.

AN ACT

To authorize the county commissioners of Sarpy county to appropriate two thousand dollars of the surplus road and bridge fund of Sarpy county to build a poor-house in said county.

Duties of county clerk of Saunders county.

For the relief of school district number one (1) of Saunders county, and State of Nebraska.

Be it enacted by the Legislature of the State of Nebraska :

SECTION 1. That the county clerk of Saunders county be and is hereby authorized and directed to place upon the tax list and duplicate of said county for the year one thousand eight hundred and seventy-four the sum of ten mills on the dollar, on the property listed by the assessor in school district number one of said county, the same to collected by the county treasurer and applied solely by the district board to the payment of the interest on the bonded indebtedness of said district, and the payment of such part of the principal of the bonded indebtedness as may fall due during the year one thousand eight hundred and seventy-five.

AN ACT

To anable any precinct of Saunders county to vote bonds to aid in the construction of a wagon bridge across the Platte river, and to provide for the construction of the same.

Be it enacted by the Legislature of the State of Nebraska:

SECTION 1. That any precinct of Saunders county, in Bonds to aid in this State, is hereby authorized to issue bonds not exceed- across Platte ing ten per cent. of the assessed valuation of all the taxable property in any such precinct, for the purpose of aiding in the construction of a wagon bridge across the Platte river, at the point on said river where the state road (located under the provisions of an act entitled "An act to locate and open a state road from the city of Omaha, in Douglas county, to intersect the Ashland and Fremont road, and to provide for the payment of the expenses thereof, approved, July 18, 1873), crosses the same.

SEC. 2. That whenever a majority of the taxable Election for inhabitants of any such precinct shall present to the county commissioners of said Saunders county, a petition in writing, setting forth therein, the amount in which said bonds are to be issued, and requesting said county commissioners to call an election in said precinct for the purpose of voting upon the question of the issuance of said bonds, the county commissioners shall issue a proclamation for such election, and the said election shall be governed in the same manner as provided in chapter thirty-five of the

revised statutes of the State of Nebraska, so far as the same is applicable: Provided however, That no such bonds shall be issued, unless it shall appear from said election, that the aggregate sum of such bonds, authorized to be issued, by the several precincts voting thereon; shall equal at least, the sum of ten thousand dollars; And, provided further, That the said precincts shall not be required to bear more than one half of the cost of the construction of said bridge.

SEC. 3. That the one half of the cost of the construction of said bridge or bridges, shall be paid by Douglas county in this state, and in the manner provided in section nine of the act aforesaid, providing for the opening and location of said state road.

That the commissioners appointed from Saunders county to locate said state road, (except that the name of Thompson Bissel, be substituted for Moses Stocking,) and the county commissioners of Douglas county or a majority of them, shall have power to determine the kind and cost of said bridge or bridges across said Platte river, and the several channels thereof, and to contract for the construction of the same, and their certificate of the estimated cost of said bridge or bridges filed with the county commissioners of said Douglas county shall be sufficient warrant for the levying by said county commissioners of said Douglas county, of the special tax provided for in section three of this act, and that the further certificate of said commissioners of the final completion of said bridge or bridges, and of the performance upon the part of the contractor or contractors of his or their contract for the construction of said bridge or bridges, filed with the county commissioners of said counties of Saunders and Douglas, shall be a sufficient warrant to the said county commissioners of said counties, for the delivery of said bonds upon the part of the said precincts in Saunders
