SECTION 1. County commissioners shall levy tax to pay precinct

bonds.

AN ACT

To amend "An act entitled an act to provide for the registration of precinct or township and school district bonds."

Be it enacted by the Legislature of the State of Nebraska:

SECTION 1. That section four of an act "To provide County comfor the registration of precinct, or township and school levy tax to pay district bonds," approved, February 27, 1873, be, and the Gen. Stat., 884. same is hereby amended so as to read as follows: Sec. 4. It shall be the duty of the board of county commissioners in each county, to levy annually upon all the taxable property in each precinct, or township and school district in such county, a tax sufficient to pay the interest accruing upon any bonds issued by such precinct, township, or school district, and to provide a sinking fund for the final redemption of the same; such levy to be made with the annual levy of the county, and the taxes collected with other taxes, and when collected, shall be, and remain in the hands of the county treasurer a specific fund for the payment of the interest upon such bonds, and for the final payment of the same at maturity. It shall be the duty of the county clerk to furnish a copy of his register to the county treasurer. It shall be the duty of all precinct, or township and school district boards, or officers, immediately after the passage of this act, to furnish the county

clerks of their respective counties, with a statement of the amount of bonds heretofore issued by their precincts, townships or school districts, and not already paid, the date of each bond, when, where, and to whom payable, the amount, the rate of interest, and when and where it is payable, which bonds shall be registered by the county clerk, in conformity with section three of the act of which this act is amendatory; and the taxes hereafter levied to pay such bonds and interest thereon, shall be levied by the county board, and collected by the county treasurer, and be and remain in his hands a specific fund for the purposes for which it is raised, in all respects as heretofore provided for in this act; and the fee for registering under this section shall be twenty-five cents for each bond, to be paid out of the contingent fund of the precinct, township, or school district.

SEC. 2. This act shall take effect and be in force from and after its passage.

AN ACT

To amend section six of an act entitled "An act for a general herd law, to protect cultivated lands from trespass by stock," approved, March 8, 1871.

Be it enacted by the Legislature of the State of Nebraska:

SECTION 1. That section six of an act entitled "An act for a general herd law to protect cultivated lands from trespass by stock, approved, March 8, 1871, which reads as follows: Sec. 6. The said arbitrators shall make an

award in writing, which, if not paid within five days after Award of an i the award has been made, may be filed with any justice of the peace in the county, and shall operate as a judgment, which judgment shall be a lien upon the stock so taken up, and execution may issue upon said stock for the colleclection of said damages and costs as in other cases: Provided, That either party may have an appeal from said judgment as in cases before justices of the peace; said arbitrators shall be allowed two dollars each for their services, be so amended as to read as follows: Sec. 6. The said arbitrator or arbitrators shall make an award in writing, which, if not paid within five days after the award has been made, may be filed with any justice of the peace in the same county, and shall operate as a judgment, which judgment shall be a lien upon the stock so taken up, and execution may issue upon said stock for the collection of said damages and costs, as in other cases: Provided, That either party may have an appeal from said judgment, as in other cases before justices of the peace; said arbitrators shall be allowed two dollars each for their services: Provided further, That if before the trial by said arbitrator or arbitrators, the owner of said stock shall tender to the person injured, an amount in lieu of said damage and costs which may have accrued, which shall equal the amount of damage afterward awarded by the arbitrators, court, or jury, or shall affirm [in] writing, to confess judgment for the same, and if, notwithstanding the said injured person refusing said offer, cause the trial to proceed, he shall pay costs and necessarily the damage awarded.

Exceptions as to operations of herd law.

SECTION 1. Exceptions as to operations of herd law.

AN ACT

To amend an act for a general herd law to protect cultivated lands from trespass by stock, passed, March 8, 1871.

Be it enacted by the Legislature of the State of Nebraska :

SECTION 1. That section nine of said act be amended to read as follows: Sec. 9. It shall be unlawful for any Gen. Stat., 85. stock to run at large upon the lands designated in sections seven and eight of this act, at any season of the year, except as exempted by section ten of this act: Provided, That the operations of this act shall not extend to the counties of Dakota, Dixon, Cedar, Knox, and Richland, and the following territory situated in Cass county, Nebraska, viz.: Beginning on the Missouri river at the corner to fractional sections twenty-eight and thirty-three, town twelve, range fourteen; thence west on section line to the quarter section corner on south side of section thirty; thence north three-quarters of a mile; thence west three-quarters of a mile; thence north one-quarter of a mile to the south line of section twenty-four, town twelve, range thirteen; thence west three-quarters of a mile to the corner to sections twenty-three, twenty-four, twentyfive and twenty-six; thence north on section line, two miles, to corner to sections eleven, twelve, thirteen and fourteen; thence west one-half a mile; thence north on quarter section line to the third standard parallel; thence east to quarter section corner on south side of section thirty-five, town thirteen, range thirteen east; thence north to the Platte river; thence down the south bank of said river to the confluence of the Platte and the Missouri

rivers; thence down the west bank of the Missouri river

to the place of beginning.

SEC. 2. All acts and parts of acts in conflict with this

act are hereby repealed.

SEC. 3. This act shall take effect and be in force from To take effect.

AN ACT

To amend section nine (9) of an act for a general herd law, &c.

Be it enacted by the Legislature of the State of Nebraska:

SECTION 1. That section nine shall be amended to Exceptions as to operations of read as follows: Sec. 9. It shall be unlawful for any herd law. stock to run at large upon the lands designated in sections Gen. Stat, 85. seven and eight of this act, at any season of the year, except as exempted by section ten of this act: Provided, That the operations of this act shall not extend to the counties of Dakota, Dixon, Cedar, Knox, or Richland: And, provided further, That the operations of this act shall not extend during December, January, and February of any year, to the counties of Thayer Nuckolls, and Webster.

SEC. 2. This act shall take effect and be in force from To take effect. and after its passage.
