Providing for the priuting of biennial reports of certain state officers.

Be it enacted by the Legislature of the State of Nebraska:.

To aid in the construction of a railroad on the west bank of the Missouri river, from Omaha to the south line of the state of Nebraska.

Whereas, The congress of the United States by an act entitled "An act to enable the people of Nebraska to form a constitution and state government, and for the admission of such state into the union on an equal footing with the original states," approved, April 19, 1864, did grant to the state of Nebraska certain lands adjoining, or near as the same could be selected, to certain salt springs, by the governor of said state; and,

Whereas, There were selected and confirmed to the state seventy-two sections of land under and by virtue of said grant; and,

Whereas, There are now about twelve thousand acres of said lands unappropriated, and which are, under section eleven of said act of congress, subject to "be used or disposed of on such terms, conditions, and regulations as the legislature shall direct;" and,

Whereas, The early construction of a railroad from Omaha through Douglas, Sarpy, Cass, Otoe, Nemaha, and Richardson counties, on the south line of the state, and to a southern connection, has become a public necessity; now, therefore,

proved, April 19, 1864, and referred to in the preamble Land grant to of this act, and which are unsold, and have not otherwise railroad. been appropriated, excepting the west half of the southwest quarter of section fourteen (14), and the east half of the southeast quarter of section fifteen (15), and the northeast quarter and the east half and the northwest quarter of the northwest quarter, and the north half of the southeast quarter, and the northeast quarter of the southwest quarter of section twenty-one (21), and the northeast quarter of the northeast quarter, and the west half of the northwest quarter, and the northwest quarter of the southwest quarter of section twenty-two (22), and the northwest quarter of the northwest quarter of section twenty-three (23), all in township ten (10), north of range six (6), east of the sixth principal meridian, State of Nebraska, which lands embrace the Chester and Lancaster salt basins, and all other sub-divisions upon which any salt springs are situated, are hereby granted to the Midland Pacific railroad company of the State of Nebraska, their successors or assigns, for the purpose of building and extending its lines of railway from Nebraska City to Omaha, and from Brownville to a connection at St. Joseph, Missouri, with other railroads, so as to form a continuous line of railway from Omaha, in Douglas county, State of Nebraska, through Sarpy, Cass, Otoe, (via Nebraska City), Nemaha, and Richardson counties, to the south line of the State of Nebraska, and thence to St. Joseph, Missouri.

SEC. 2. That whenever the Midland Pacific railway when carried company, its successors or assigns, shall construct ten miles or more, or any portion of the line of railroad as aforesaid, after the passage of this act, and complete the same ready for the rolling stock as a first class road, they shall be entitled to three hundred acres of said lands of average value, as herein granted, for each and every mile so completed on said line from Omaha to the south line of

said state, and the governor of the state shall execute to said company patents for said lands to the amount of three hundred acres per mile, upon the certificate of three commissioners, appointed by him to examine said road, that the same is completed ready for trains as aforesaid, and in like manner as each succeeding section of ten miles of said road shall be completed, said commissioners shall examine and report upon the same to the governor of the state, who likewise patent to said railway company so much of the lands herein granted as the said company may be entitled, at the rate of three hundred acres per mile: Provided, That before said lands are conveyed to said railroad company, the governor, auditor, and secretary of state shall appraise all of said lands as herein provided for, and upon such appraisal and valuation the quantity of lands conveyed to said railroad company shall be applied equally in the construction of said road between Nebraska City and Omaha as one-half of said road, and between Brownville and the south line of the state as the other half of said road.

SEC. 3. Said Midland Pacific railway company may have two years, from and after the passage of this act, in which to complete said line of railway and comply with the terms of this act, which shall be exclusive to said company: Provided, Said Midland Pacific railway company shall commence work on said road between Nebraska City, in Otoe county, and Plattsmouth, in Cass county, during the year 1875; and in case of its failure to do so, the lands to be applied on that portion of said line shall revert to any railroad company, or construction company, that may construct that portion of said line: Provided, That no lands or the proceeds thereof shall apply to any portion of said line of road on which any work has been done prior to the passage of this act: And provided further, That if the provisions contained in this act were not

complied with within two years, said railroad company shall not be entitled to any part of said lands: And further provided, That the provisions of this act shall not in any manner apply to sections twenty-one and twenty-two in town ten, north of range six, east of the sixth principal meridian, in Lancaster county, Nebraska.

SEC. 4. All acts and parts of acts inconsistent with this act are hereby repealed.
