premises or other places, and carry such person, or persons, and such intoxicating liquors, materials, or still equipment, machinery or device before the judge or justice issuing the warrant to be dealt with accordingly to law, and upon conviction of the person or persons, or any one of them in charge of such house, or in possession of such premises or intoxicating liquors, or still equipment, machinery or device, for the manufacture of such intoxicating liquors, in violation of this Act, the judge, justice of the peace, or court trying such offender, or offenders, shall enter judgment against the defendant as herein provided, and shall declare the intoxicating liquors, still or stills, material or equipment, machinery or devices seized, or to be contraband and confiscate the same at once, and have the same immediately destroyed.

§ 2. If any person shall arrest, or directly or indirectly cause the arrest of any person guilty of violating Section 1 hereof, within this Commonwealth, and shall secure the indictment and conviction of such person in a court of competent jurisdiction, the person so securing the arrest, indictment and conviction shall be entitled to a reward of fifty dollars for each defendant convicted, which reward shall be paid by the fiscal court of the county in which the indictment may be returned, out of the county levy of such county, not otherwise appropriated.

3. An illicit or "moonshine" still under this Act shall include an outfit or parts of an outfit commonly and exclusively used in the distillation of spirituous liquors, which is not at the time of trial duly registered in the office of a Collector of Internal Revenue for the United States, and the burden of

proving that same is so registered shall be on the defendant under charge.

§ 4. All laws and parts of laws in conflict herewith are hereby repealed.

§ 5. For the reason that the Federal Government has changed its policy with reference to the enforcement of the laws against illicit distilling, and for the reason that numerous and divers illicit stills are now running in the Commonwealth, an emergency is hereby declared to exist, and this Act shall become effective from and after its passage. CHAPTER 169.

AN ACT for the improvement of the public highways of this Commonwealth.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That it shall be the duty of every owner, controller and manager of lands bordering and abutting on the public highways of this Commonwealth, for the distance which their said land so abuts and borders, when so ordered by the fiscal court of his county, to cut, clear away, remove and carry from along side the public highways, all bushes, weeds, shrubs and overhanging limbs of trees and all other such obstructions along such highways and to keep all hedge fences along such highway so trimmed and cut back, that same, at no time will become more than five feet high.

2. The brush, bushes, weeds, overhanging limbs of trees and all other obstructions along the highways of the several counties of this Commonwealth are to be removed therefrom between the

1st day of July and the 20th day of August of every year, and it shall be the duty of the County Road Engineer of the several counties of this Commonwealth to publish in some county paper of the county in which they act for at least two consecutive weeks 'before the first day of July of every year and to give notice by handbills posted in not less than ten conspicuous places in each voting precinct of their counties outside of the incorporated towns, the requirements of this act and the duties incumbent on such persons as own, control and manage lands bordering and abutting on the public highways.

§ 3. Every person who violates the provisions of this act by failure to perform the duties as herein required shall on conviction be fined in a sum of not less than twenty dollars nor more than fifty dollars. And the County Road Engineer shall on conviction be fined in the sum of not less than twenty-five dollars nor more than one hundred dollars for his failure to publish the notices as herein required.

§ 4. The costs of publication of the notices herein required are to be paid by the fiscal court of the county in which the notices were published and posted.

§ 5. All laws or parts of laws in conflict with this act are hereby repealed.

Neither approved nor disapproved.

CHAPTER 170.

AN ACT to amend Section 965 Kentucky Statutes relating to circuit courts in the Twelfth Judicial District.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

That Section 965 of the Kentucky Statutes in so far as it relates to the Twelfth Circuit Court Dis

trict be and the same is hereby amended by striking out the whole of the following portion of said Section 965, which portion so stricken out was an amendment of said Section 965 by Act of the General Assembly Session 1910, page 199.

The portion so stricken out is in words and figures as follows, to-wit:

"Twelfth District.-Trimble County, at Bedford, on the first Monday in January, six juridical days; Henry County, at New Castle, second Monday in January, twelve juridical days; Shelby County, at Shelbyville, fourth Monday in January, eighteen juridical days; Oldham County, at LaGrange, third Monday in February, twelve juridical days; Anderson County, at Lawrenceburg, first Monday in March, twelve juridical days; Spencer County, at Taylorsville, third Monday in March, twelve juridical days; Trimble County, at Bedford, first Monday in April, twelve juridical days; Henry County, at New Castle, third Monday in April, twelve juridical days; Shelby County, at Shelbyville, first Monday in May, eighteen juridical days; Oldham County, at LaGrange, fourth Monday in May, twelve juridical days; Spencer County, at Taylorsville, second Monday in June, six juridical days; Anderson County at Lawrenceburg, third Monday in June, twelve juridical days; Trimble County, at Bedford, first Monday in September, six juridical days; Henry County, at New Castle, second Monday in September, twelve juridical days; Shelby County, at Shelbyville, fourth Monday in September, eighteen juridical days; Oldham County, at LaGrange, third Monday in October, six juridical days; Spencer County, at Taylorsville, fourth Monday in October, twelve juridical days; Anderson County at Lawrenceburg, second Monday in November, twelve juridical days."

So that said portion of said section as amended will read as follows:
