posed of under the terms of the particular appropriation or donation.

$10. The council shall use earnest efforts to support the policy of the Federal Government to place before the citizens of the State the reasons for the war, and for the various government activities in support of the war, shall endeavor to send speakers to the various counties and precincts of the State, shall with the aid of publicity committees furnish literature to newspapers of the State, and expend if necessary reasonable amounts in the circulation of papers, magazines and pamphlets of educational value, and in the publication and circulation of an official bulletin, and shall have all powers which may be deemed necessary or desirable to accomplish the general purposes of said council, and may exercise all powers which may be conferred upon it by the General Assembly of Kentucky or by the Congress.

§ 11. As soon as may be after the creation of said council, same shall be called together by the chairman and organized. It shall have the power to make all appropriate by-laws, rules and regulations for carrying on the business of the council, and shall have the right to form advisory or other committees outside of its membership. It may provide for the organization of subordinate bodies for its assistance in each of the counties and precincts of the State, the members of which shall be appointed by the chairman of said council with the approval of the Governor, and may appoint committees or agencies for special investigations, either by the employment of experts or by the creation of committees of specially qualified persons or both. All such committees and bodies and individuals shall report to said council periodically and also as may

be required by said council, and shall act under its direction.

§ 12. There is hereby appropriated out of the general funds of the State the sum of fifty thousand ($50,000.00) dollars per annum for two years for the work of said council, to be paid under resolutions of said council out of the general funds, or out of such special funds as may be provided by the General Assembly of Kentucky, upon warrant drawn by the Auditor upon the requisition of the Governor upon the Treasurer of the State of Kentucky.

13. The members of said council shall serve without compensation other than actual traveling and hotel expenses when traveling and engaged upon the business of said council. The council may pay such officers and agents as it may employ reasonable compensation for specific work done. No agreement for compensation and no voucher for expenses or money paid shall be valid or honored unless approved by the Governor or by the chairman of the council, and also authorized by a quorum of said council or executive committee. Said council may employ, at regular salaries, such expert and clerical assistance and help as may be necessary and proper, and pay a reasonable compensation therefor.

§ 14. Said council shall render to the Governor on the first day of January in each year and through the Governor to the Legislature at each session a full account of its activities during the preceding year, and an itemized statement of all moneys paid out by it of the expenditure of all funds drawn from the State treasury.

15. Said council shall have authority to requisition from the Superintendent of Public Print

ing or the Board of Printing Commissioners such printing and office supplies as may be necessary for its work, the cost thereof to be paid for out of the appropriation herein provided for.

§ 16. Unless called by the chairman to meet elsewhere, the members of the Kentucky Council of Defense shall hold all meetings in Louisville, Kentucky, and said council shall have the right to expend such reasonable sums as may be necessary to establish and maintain offices in that city. The chairman shall have the right to call a meeting of the council at any other place in the State of Kentucky.

§ 17. All laws or parts of laws inconsistent with the provisions of the act are hereby repealed, and in the event any provision of this act should be held to be invalid or inoperative the remaining provisions of this act shall remain in full force and effect.

An emergency is declared and this act shall take effect from and after its passage.

CHAPTER 10.

AN ACT making it unlawful for any citizen or subject of any nation with which the United States is at war to have firearms or other explosives in his possession.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. It shall be unlawful for any citizen or subject of any nation with which the United States is at war, to have in his possession or under his control any firearms of any kind or nature whatever, or any explosive of any kind or nature whatsoever. or the ingredients of any explosive from which explosives could be manufactured. Provided, however,

that any such person having in his possession or under his control any such forbidden article shall have ten days from and after the passage of this act to dispose of same.

2. Any person violating any provision of this act shall be guilty of a misdemeanor and shall be fined not less than twenty dollars ($20.00) nor more than one hundred dollars ($100.00) or imprisoned in the county jail for not less than twenty (20) nor more than sixty (60) days, or be both so fined and imprisoned. Upon such conviction any such forbidden article shall be confiscated by and become the property of the Commonwealth and each day any provision of this act is violated shall constitute a separate offense.

§ 3. Any police officer of this State is hereby authorized summarily to arrest any person violating any of the provisions of this act and if the presence of any such article be suspected on or about the premises occupied by or under the control of such alien, enter and search such premises for the purpose of ascertaining whether any such forbidden article is in the possession of or under the control ⚫ of such alien.

§ 4. On account of existing war conditions an emergency is hereby declared to exist and this act shall take effect from and after its approval by the Governor.

CHAPTER 11.

AN ACT to abolish the assessor's office and to provide in lieu thereof a county tax commission; prescribing the duties and qualifications of the county tax commission, and the duties of taxpayers in relation thereto.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. Powers of County Assessor Transferred to the County Tax Commissioner. The office of county assessor is hereby abolished under the provisions of Section 104 of the Constitution and the present incumbents shall be made county tax commissioners. There are hereby transferred to the State Tax Commission and County Tax Commissioners all the powers and duties heretofore exercised by, or performed by the county assessors, in so far as such powers and duties are not changed by law. The County Tax Commissioners and their deputies shall exercise and perform such other powers and duties as may be imposed upon them by law, or by the orders of the State Tax Commission.

§ 2. Election of County Commissioners.-The term of office of such County Tax Commissioners shall be equal to the term of office of the county assessors, and they shall be elected as assessors are now elected by law subject to the qualification provided for in this act, except that the County Tax Commissioners shall be eligible for re-election.

Penalty for Failure to Qualify. Any person elected a County Tax Commissioner, who shall wilfully fail to accept the office and discharge the duties. thereof, shall be fined five hundred dollars. Each County Tax Commissioner herein provided for may, with the approval of the State Tax Commission, appoint as many sober, discreet, capable persons not under the age of twenty-one years, as deputies. to assist him to discharge his duties, as he may deem necessary, and may remove them at his pleasure. The County Tax Commissioner and his deputies shall read and administer the oath required to be taken by persons whose property is required to be listed for taxation. The County Tax Commissioner and his deputies, before they enter upon
