ruary, June and October and continue twelve juridical days each. Cumberland county, on third Mondays in March and July and the fourth Monday in November and continue twelve juridical days each. Russell county, on the third Mondays in February, June and October and continue twelve juridical days each. Monroe county, on the first Mondays in April and August and the second Monday in December and continue twelve juridical days each.

Thirty-third District. Perry county, first Monday in January, May and October and continue twenty-four juridical days each. Leslie county, first Monday in February, and continue twenty juridical days and first Monday in June and November and continue eighteen juridical days each. Owsley county, first Monday in March, fourth Monday in June and November and continue twelve juridical days each.

Thirty-fourth District. Whitley county, fourth Monday in January and continue thirty-six juridical days. Second Monday in May and continue thirty juridical days. Third Monday in September and continue thirty-six juridical days each. McCreary county, second Monday in March, third Monday in June, first Monday in November and continue eighteen juridical days each. Knox county, first Monday in April and continue thirty juridical days; third Monday in August, fourth Monday in November and continue twenty-four juridical days each.

§ 2. On account of the urgent necessity of the $ immediate change in the dates of holding said circuit courts, and an emergency is hereby declared to exist and this bill shall take effect immediately upon its passage and approval by the Governor.

CHAPTER 9.

AN ACT to create the Kentucky Council of Defense, defining its powers, purposes, objects and duties and providing an appropriation therefor.

Be it enacted by the General Assembly of the Commonwealth of Kentucky:

§ 1. That there is hereby created a board and public body corporate to be known as the Kentucky Council of Defense.

§ 2. The objects, powers and purposes of said council shall be to assist the State and Federal Governments during the continuance of war. Said council shall cease to exist, unless continued by legislative enactments, at the end of the session of the General Assembly of Kentucky, either special or general, which shall sit next after the termination of the existing war with Germany and Austria.

3. Said council shall be composed of nine members to be appointed by the Governor without regard to party or political affiliation, one of whom shall be designated by the Governor as chairman, and five of whom shall constitute a quorum. Said council may, by appropriate resolution, appoint an executive committee consisting of not less than three of its members, and may by resolution vest said committee with all the powers of the council until the same shall be rescinded by a majority vote of the members. Said council may appoint or employ such officers or agents as may be necessary to carry on the business of the council. The members shall hold office for four years or until the council shall cease to exist, but a member may be removed by the Governor at any time for good cause. Vacancies in the council shall be filled by the Governor.

4. Upon organization the Kentucky Council of

Defense shall immediately notify the National Council of Defense of its readiness for co-operation with it and with all Federal agencies in every possible manner looking to the defense of the nation and the public welfare. Said Kentucky Council shall also communicate with the Councils of other States and exchange with them all data necessary and desirable for their common use and co-operate with them. § 5. Said council by itself or through its agents and employees shall have power to make full investigation as to all questions directly or indirectly relating to or bearing upon the purposes referred to in this act. It shall have power to subpoena witnesses and to require their testimony under oath, and to compel by subpoena duces tecum the production of books, accounts, files, papers and other written or printed documents deemed relevant to any investigation or matter which may be under consideration by such council. Said powers contained in this section are likewise conferred upon sub-committees and other bodies and agents of said council authorized by this act or to be appointed or created, when authorized and directed by the Kentucky Council of Defense to exercise such powers. In case of refusal of any person or corporation to comply with any subpoena issued hereunder, or to testify to any matter requiring which interrogation may be made, such facts shall be made to appear by petition filed with the judge of the circuit court of the county in which said witness is required to appear by petition filed in the name of the Kentucky Council of Defense, through its agent or attorney, in which petition there shall be set out the facts relative to the issuance of said subpoena, a general summary in substance of the character of the testimony desired or documents produced,

and the witness or witnesses and the person or persons or corporations refusing to comply with said subpoena. Upon the filing of said petition, verified by a representative of said Kentucky Council of Defense, the said judge shall issue a rule requiring the person or persons or corporation complained of to appear at such time as the judge may designate, and within five (5) days of the date of the fil ing of said petition, and show cause why said person or corporation should not be held in contempt of the orders of said Kentucky Council of Defense. Said petition and rule shall be served upon the respondent at least three (3) days before the date of the hearing, which hearing may be held either at chambers or during term time. Should the respondent fail to appear in response to said order, or to render satisfactory explanation for refusing to comply with the subpoena or order of said Kentucky Council of Defense, then said judge may hold said person or corporation to be in contempt of said order, and may impose such fine or imprisonment as is now provided by law in cases of contempt of the circuit court. Said hearing shall be before the judge upon affidavit; or upon oral testimony, as the judge hearing the case may direct, and the laws applicable to exception and appeal shall be applicable to said hearing.

§ 6. It shall be within the powers of the Kentucky Council of Defense to appoint, in different counties and precincts of the State of Kentucky, special representatives or resident councillors or associate councillors whose duty it shall be to vigilantly guard the interests of the State and to report treasonable acts or utterances, or such acts or utterances as are inimical to the prosecution of the war, and under direction of the council to warn persons or bodies

guilty of such acts or utterances, and to exercise such other powers as may be bestowed upon them in said behalf by said council or by the General Assembly of Kentucky, or by the Congress. Said council is hereby authorized and empowered, when the necessity arises, which fact shall be determined. by a two-thirds vote of the full membership of the said council, to call upon and direct the governing authorities of all counties and municipalities of Kentucky to co-operate with said council in furtherance of its orders, and in regard to all investigations directed by said council.

§ 7. It shall be the duty of said council and it shall have the power to initiate and carry on within the State measures to co-ordinate the war activities of the State with those of the Federal Government and other States, to bring about the highest efficiency within the State in everything relating directly or indirectly to the war, and to meet the emergencies in the State because of the existence of the war. $. 8. Said council shall co-ordinate the activities within the State of all voluntary organizations and committees engaged in patriotic service, and supervise the solicitation of funds within the State by all such organizations and committees.

9. Said Kentucky Council of Defense is hereby authorized to receive appropriations from the State of Kentucky, and from other States and municipalities, and donations from private individuals, and to use and account for the same for the purposes of said council. If any fund should be remaining in its hands after the expiration of its duties, the same shall be covered into the treasury of the State of Kentucky for the general purposes of the State, unless otherwise directed to be dis
