Chapter 261.

An Act amendatory to Chapter three of the Private and Special laws of eighteen hundred and eighty-seven entitled "An Act to supply the people of the town of Presque Isle with pure water."

Be it enacted by the People of the State of Maine, as follows:

That section six of chapter three of the private and special laws of eighteen hundred and eighty-seven, be, and hereby is, amended so to read as follows:

"The capital stock of this corporation shall be one hundred capital thousand dollars, and shall be divided into shares of one hundred dollars each.'

Chapter 262.

An Act to amend Chapter one hundred and thirty-one of the Private and
Special Laws of eighteen hundred and fifty-eight as amended by
Chapter fifty-three of the Private and Special Laws of eighteen hun-
dred and eighty seven, relating to the Preachers' Aid Society of the
Methodist Episcopal Church.

Be it enacted by the People of the State of Maine, as follows:

Section one of chapter fifty-three of the private and special laws of eighteen hundred and eighty-seven is hereby amended by striking out the word "fifty" in the fifteenth line of said chapter, and inserting in the place thereof the words 'one hundred;' so that said section as amended shall read as follows: 'Daniel B. Randall, John Allen, E. Martin, S. F. Wetherbee, Corporators. Stephen Allen, Charles F. Allen, Israel Luce, C. E. Bisbee, Charles J. Clark, Roscoe Sanderson, W. S. Jones, E. S. Stackpole, A. W. Pottle, E. T. Adams, J. Gerrish and M. C. Pendexter being present members of said board, their associates and successors are hereby continued and created a body corporate by the name of the Preachers' Aid Society of the Maine Con- corporate ference of the Methodist Episcopal Church, with all the powers incident to corporations under the general laws of the state, and by that name shall have power to prosecute and defend suits -powers. at law, to have and own a common seal and to change the same at pleasure, to take and hold for the objects of their association by gift, grant, donation, devise, bequest, purchase, or otherwise, any estate, real or personal, to an amount not exceeding one hundred thousand dollars, and to sell and convey any estate, real or personal, which the interests of said corporation may require

Chapter 263.

An Act to amend Section one of Chapter four hundred and twelve of the
Private and Special Laws of nineteen hundred and seven, as amended
by Section one of Chapter one hundred twenty-one of the Private and
Special Laws of nineteen hundred and nine, regulating Fishing in
Swift River and its tributaries, in the County of Oxford and in the
County of Franklin.

Be it enacted by the People of the State of Maine, as follows: Section one of chapter four hundred and twelve of the prispecial laws, vate and special laws of nineteen hundred and seven, as amended by section one of chapter one hundred and twenty-one of chapter 121, the private and special laws of nineteen hundred and nine, is hereby amended by striking out the word "Monday" in the eighth line of said section, as amended, and by striking out the word "and" after the word "June" in the ninth line thereof, and by inserting after the word "July" in the ninth line thereof the words and August,' so that said section, as amended, shall read as follows:

Fishing in Swift river and tributaries, regulated.

'Section I. It shall be unlawful to fish for, take, catch or kill any kind of fish at any time in Swift river, so-called, or in any of the streams tributary thereto, situated in Rumford, Mexico, Roxbury, Byron and plantations D and E, in the counties of Oxford and Franklin, including Swift river pond, except that it shall be lawful to fish in accordance with the general law of the state in the river itself and in any of its tributaries on Tuesday, Thursday and Saturday of each week during the months of May, June, July and August of each year. And no person shall catch, take or kill over thirty-five fish of lawful size in any one day from any or all of these waters, under a penalty of one dollar for each and every fish caught or killed in excess of said thirty-five.'

Chapter three hundred and sixty-eight of the private and Chapter 368, special laws of the year nineteen hundred and nine is hereby amended by striking out the words "said city" in the fifth line of section one and inserting in place of the same words 'Knox county,' so that said section as amended shall read as follows: 'Section 1. There is hereby established in the city of Rockland, a court to be denominated the police court for the city of Rockland, to consist of one judge, who shall be appointed, commissioned and qualified in the manner provided by the constitution of this state, and be a citizen of Knox county, and so continue while he remains in office. Also one recorder who shall be a citizen of Knox county, to be appointed by the governor, by and with the consent of the council, commissioned and qualified in the manner provided by law. Said police court shall be shall be a a court of record with a seal to be affixed to all original process- ord. es issued therefrom. The present judge shall continue in office until the end of the term, for which he was appointed.'

An Act to close Square Pond to Sewerage.

Be it enacted by the People of the State of Maine, as follows: Section I. Section 2. Chapter 266.

An Act to incorporate the Swan's Island Water Company.

Be it enacted by the People of the State of Maine, as follows:

Section 1. Herbert W. Joyce, William Herrick, William B. Lindsey, Frank E. Bridges, and Isaac W. Stinson, their associates, successors, and assigns are hereby made a corporation by the name of the Swan's Island Water Company, for the purpose of supplying the town of Swan's Island in the county of Hancock and the inhabitants of said town with pure water for domestic, sanitary, municipal, and public purposes including the extinguishment of fires.

Section 2. Said company for said purposes may retain, collect, take, store, use, and distribute water from any springs, except such springs as are actually used for domestic purposes, ponds, streams, or other water sources in said Swan's Island, and may locate, construct, and maintain cribs, reservoirs, aqueducts, gates, pipes, hydrants, and all other necessary structures therefor.

Section 3. Said company is hereby authorized to lay, construct and maintain in, under, through, along and across the highways, ways, streets, railroads and bridges in said town, and to take up, replace and repair all such sluices, aqueducts, pipes, hydrants, and structures as may be necessary for the purposes of its incorporation so as not to unreasonably obstruct the same, under such reasonable restrictions as the selectmen of said town may impose. It shall be responsible for all damages to persons and property occasioned by the use of such highways, ways, and streets and shall further be liable to pay to said town all sums recovered against said town for damages for obstructions caused by said company and for all expenses, including reason

Section 5. Said company may take and hold any waters as limited in section two, and also any lands necessary for reservoirs, and other necessary structures and may locate, lay and maintain aqueducts, pipes, hydrants, and other necessary structures or fixtures in, over and through any lands for its said purposes, and excavate in and through such lands for such locations, constructions and maintenance. It may enter upon such lands to make surveys and locations, and shall file in the registry make of deeds for said county of Hancock, plans of such locations shall file and lands, showing the property taken and within thirty days thereafter, publish notice of such filing in some newspaper in said county, such publication to be continued three weeks successively.

Section 6. Should said company and the owner of such land Damages, so taken be unable to agree upon the damages to be paid for such location, taking, holding, and construction, the damages shall be assessed in accordance with the law applicable to the assessment of damages for ways taken by railroads, so far as such law is consistent with the provisions of this act. If said company shall fail to pay such land owner, or deposit for his use with the clerk of the county commissioners, in the said county of Hancock, such sum as may be finally awarded as damages, with costs when recovered by him, within ninety days after notice of final judgment shall have been received by the clerk of courts of said county, the said location shall be hereby invalid, and said company forfeit all rights under the same as against such land owner. Said company may make a tender to any land owner damaged under the provisions of this act, and, if such land owner recovers more damages than were tendered by said company, he shall recover costs, otherwise said company shall re
