Fifty-Second Session

WEDNESDAY, January 13, 1915.

The fifty-second session of the legislature of the state of Wisconsin began at Madison, the capital city of said state, on the second Wednesday, being the thirteenth day of January, A. D. 1915, pursuant to law, at 12:00 o'clock noon.

The senate was called to order by Hon. Edward F. Dithmar, president of the senate.

Prayer was offered by Rev. E. G. Updike.

The following communication was read by Chief Clerk Wylie:

Donald, secretary of state of the State of Wisconsin, do hereby certify that the foregoing is a true and correct list of the members of the senate of the state of Wisconsin, elected at the general election held on the 3rd day of November, A. D. 1914, as appears from certificates of the Board of State Canvassers and of the county clerks of Milwaukee and Winnebago counties, which certificates are now on file in this office. The roll of newly elected senators being called, the following appeared at the bar of the senate and subscribed to the oath of office, which was administered by the president, viz.:

Senators Perry, Everett, Fairchild, Arnold, Jennings, Baxter, Barwig, Rollmann, Whitman, Bray, Hanson, Potts, Albers, Staudenmayer, Scott, Bennett, and Mulberger.

The roll was thereupon called by Chief Clerk Wylie and the following senators answered to their names:

Senators Ackley, Albers, Arnold, Barwig, Baxter, Bennett, Bichler, Bosshard, Bray, Burke, Culbertson, Cunningham, Everett, Fairchild, Glenn, Hanson, Huber, Jennings, Kellogg, Martin, Monk, Mulberger, Perry, Potts, Richards, Rollmann, Scott, Skogmo, Staudenmayer, Stevens, Tomkins, Weissleder and Whitman—33.

Senator Weissleder addressed the senate, saying that his title to a seat had been challenged in the Circuit Court of the county of Milwaukee, in a mandamus proceeding to compel the county clerk to place the name of a candidate on the election ballot. Senator Weissleder stated that he wished to lay the matter before the senate; that the fact was that because of illness in his family he was temporarily occupying lodgings in another district, but that he still maintained his legal residence in the 6th District, from which he was elected, certified, and seated in 1913.

Senator Richards moved that the senate declare Senator Weissleder legally entitled to represent the 6th Senatorial District in the Senate of 1915.

Several senators suggested that no challenge of Senator Weissleder's right having been addressed to the senate, no action by the senate need be taken, and that Senator Weissleder retain his status as the senator from the 6th Senatorial District.

No action was taken.

Upon motion of Senator Burke the senate proceeded to

ELECTION OF PRESIDENT PRO TEMPORE.

Senator Burke presented the name of Edward F. Fairchild.

Senator Bosshard presented the name of George E. Scott.

Senator Albers presented the name of W. J. Bichler.

The roll was called and the following senators voted for Senator Fairchild:

Senators Ackley, Baxter, Bennett, Bray, Burke, Cunningham, Everett, Hanson, Martin, Perry, Richards, Scott, Stevens and Whitman-14.

The following senators voted for Senator Scott:

Senators Bosshard, Culbertson, Fairchild, Glenn, Huber, Monk, Potts, Skogmo and Tomkins—9.

The following senators voted for Senator Bichler:

Senators Albers, Barwig, Jennings, Kellogg, Mulberger, Rollmann, Staudenmayer and Weissleder-8.

Senator Bichler voted for Senator Albers.
Senator Arnold voted present.

Upon motion of Senator Burke, the senate proceeded to another ballot.

The roll was called and the following senators voted for Senator Fairchild:

Senators Ackley, Baxter, Bennett, Bray, Burke, Cunningham, Everett, Hanson, Martin, Perry, Richards, Scott, Stevens and Whitman-14.

The following senators voted for Senator Scott:

Senators Bosshard, Culbertson, Fairchild, Glenn, Huber, Monk, Potts, Slogmo and Tomkins-9.

The following senators voted for Senator Bichler:

Senators Albers, Barwig, Jennings, Kellogg, Mulberger, Rollmann, Staudenmayer and Weissleder-8.

Senator Bichler voted for Senator Albers.
