EXECUTIVE COMMUNICATION

The appointment of Dr. Charles Sutherland was taken

up at this time.

The question was: Shall the nomination by the governor of Doctor Charles Sutherland of Janesville to be a member of the state board of health and vital statistics for the term ending on the first Monday in February, 1921, be confirmed?

The ayes and noes were requested and the vote was: Ayes, 27; noes, none; absent or not voting, 6; as follows: Ayes-Senators Ackley, Arnold, Barwig, Baxter, Bennett, Bichler, Bosshard, Bray, Burke, Culbertson, Cunningham, Everett, Glenn, Hanson, Huber, Jennings, Kellogg, Martin, Monk, Mulberger, Perry, Potts,

Stevens, Weissleder and Whitman-27.

Absent or not voting-Senators Albers, Fairchild, Richards, Rollmann, Skogmo and Tomkins-6.

So the nomination was confirmed.

Senator Perry moved that all joint resolutions reported by the committee on Education and Public Welfare be indefinitely postponed, and that separate consideration be denied.

Senator Ackley moved the previous question, which motion was seconded by the required number of senators. Senator Bosshard rose to the point of order that unless unanimous consent was granted each resolution must be considered separately.

Senator Ackley arose to say that the time had passed in which the senator could raise the point of order because the previous question had been put.

Senator Bichler arose to say that whether the points of order were well taken or not, senators could not be deprived of their right to vote on each measure separately without unanimous consent.

Senator Burke held that the previous question was always in order.

Senator Bray rose to the point of order that Jt. Res. No. 24, S., being privileged should have consideration before others.

The president held the point of order not well taken. The question was: Shall the previous question be now put?

The ayes and noes were required and the vote was: Ayes, 16; noes, 12; absent or not voting, 5; as follows:

Ayes-Senators Ackley, Baxter, Bennett, Burke, Culbertson, Cunningham, Glenn, Hanson, Jennings, Kellogg, Martin, Perry, Potts, Stevens, Weissleder and Whitman16.

Noes-Senators Arnold, Barwig, Bichler, Bosshard, Bray, Everett, Huber, Monk, Mulberger, Scott, Skogmo and Staudenmayer-12.

So the previous question was ordered put.

Senator Bosshard arose to the point of order that separate action must be taken on each resolution unless the rules were suspended, and that the motion to deny separate action was out of order.

Senator Perry with unanimous consent withdrew his motion, and then moved that the joint resolutions be taken up in the order reported by the committee on Education and Public Welfare.

Which motion was agreed to.

Senator Bosshard moved that the joint resolution be adopted.

Senator Bray offered substitute amendment No. 1, S., and moved that it be acted upon at this time,

Which motion was declared out of order.

Senator Bosshard asked unanimous consent that the substitute amendment be considered at this time,

Which consent was granted.

The question was: Shall substitute amendment No. 1, S. to Jt. Res. No. 8, S. be adopted?

The ayes and noes were requested, and the vote was: Ayes, 1; noes, 26; absent or not voting, 5; as follows: Ayes Senator Bray.
