I am directed to inform you that the Assembly has passed and asks concurrence in

Senator Tomkins moved that the senate adjourn. Senator Kellogg moved to fix the time to which to adjourn as Monday, at 9 o'clock, p. m.

Senator Fairchild moved that the senate return to Order

No. 5.

Senator Bichler arose to a point of order that the motions regarding adjournment should take precedence.

The president held the point of order well taken and the question was: Shall the senate fix the time to which to adjourn as Monday, at 9 o'clock, p. m?

A division was called for and the senate refused to agree

to the motion.

The senate then refused to adjourn.

Fixing the time to which to adjourn as Tuesday, February

9, at 1:30 o'clock, p. m.

The question was: Shall the resolution be concurred in?

The ayes and noes were requested, and the vote was: Ayes, 7; noes, 16; absent or not voting, 10; as follows:

Ayes Senators Bray, Everett, Fairchild, Hanson, Huber, Jennings and Potts-7.

Noes-Senators Arnold, Barwig, Bennett, Bichler, Culbertson, Glenn, Kellogg, Monk, Perry, Rollmann, Scott, Skogmo, Staudenmayer, Stevens, Tomkins and Whitman16.

Absent or not voting-Senators Ackley, Albers, Baxter, Bosshard, Burke, Cunningham, Martin, Mulberger, Richards and Weissleder-10.

And so the senate refused to concur in the joint resolution.

Leave of absence was granted to senators, upon request, as follows:

Senators Mulberger, Jennings, Potts, Culbertson and Huber, until Tuesday; Senators Stevens, Cunningham and Everett for tomorrow.

Senator Kellogg moved that the senate adjourn.

A division was called for and the senate was equally divided.
