to meet their estimates in the future, to provide for making immediate settlement with them, and for the surrendering of their contracts to be cancelled.

It is certainly to be much regretted, that the means are likely to be inadequate, to the full completion of this important improvement; and that it seems almost necessary, to arrest the works, to protect the State from a public debt. But while the Constitution remains as it does, I see no other way, for the completion of the improvement, except to obtain another grant from Congress, or submit the works to private enterprize.

Whatever question there may be about this, or that, class of indebtedness on account of this work, being State indebtedness, one question, at least, would now seem to be of great importance, and that is,-

Whether, inasmuch as it is now ascertained, that the trust fund for that purpose, will not be sufficient, if the State continues the prosecution of the work, under the direction and supervision of her officers and agents, she does not, thereby become directly liable, for the payment for such works.

The importance of the subject, and the complicated questions arising out of its consideration, must be my apology for the length of this communication.

With the fullest confidence, that your wisdom will devise the proper legislative measures upon this subject, I submit it to your discretion.

Resolved, By the Senate, that the Judiciary Committee be required to report whether in their opinion, the State of Wisconsin is or may become liable for any debt contracted in pursuance of any law in this State, now in force, or heretofore enacted, providing for the Improvement of the Fox and Wisconsin Rivers.

Said bill No. 1 S., was laid aside until afternoon.

Mr. Pinkney, on leave granted, introduced the following resolution:

Resolved, That a committee of three be appointed, whose duty it shall be to compile and prepare for publication all acts and parts of acts and joint resolutions passed by the different Legislatures of this State from time to time, and all contracts entered into between the State, and all contractors having any reference to the Fox and Wisconsin River Improvement, and that

copies of said acts, joint resolutions and contracts be printed together, in pamphlet form, for the use of the Senate.

Mr. Pinkney moved that the rules be suspended and said resolution be considered now,

Which was agreed to.

Pending the consideratiou of said resolution,

On motion of Mr. Cary,

The Senate adjourned until 3 o'clock, in the afternoon.

The following resolution, the consideration of which was pending at the adjournment of the forenoon session, was taken

Mr. Pinkney moved to amend the amendment of the committee of the whole to Sec. 9 of said bill, by striking out Ripon and Berlin, and inserting the town of Ceresco, and also through the town of Berlin, crossing the Fox river within the limits of the said town of Berlin; provided, that the said road shall not run over one mile distant from the villages of Ripon and Berlin,

Which was agreed to.

The amendments of the committee of the whole as amended, were then concurred in.

The question being upon ordering said bill to be engrossed and read the third time,
