of the largest circulation in the state of Nebraska, one in Chicago, Illinois, and one in St. Joseph, Missouri, for thirty days, for plans and specifications for the main building of the state house of the state of Nebraska. The interior of said main building, to conform in every respect to the plans heretofore submitted by Wlliam H. Wilcox, architect, and the interior to contain the proper offices in accordance with the plans above mentioned, and the necessary improvement of the capitol grounds. The said building shall contain all the necessary stairways, gas pipes, plumbing, drain pipes, ventilating shafts or ducts, and flues necessary for heating by steam and properly ventilating the same: Provided, that if William H. Wilcox, Proviso conarchitect of the plans for the east and west wings, heretofore adopted, will furnish the plans for the main building, same with all the details, specifications and working detailed drawings necessary under the contract for the construction of said buildings, as rapidly as the work may progress, for a sum not to exceed three-fourths of one per cent of the contract price, to be paid as hereinafter specified; and said board shall deem the same to comply with requirements of said building; that it shall be the duty of the board of the board of public lands and buildings to adopt such plans within ten days after the taking effect of this act, and no advertising as heretofore specified shall be necessary.

SEC. 4. Should the board be compelled to advertise for plans and specifications, as provided in the first plan. part of section three of this act, then, within ten days after the day named in the advertisement, it shall be the duty of the said board, in conjunction with a competent builder, who shall not be interested in the contract of the letting thereof-said builder to be ap

pointed by the governor-to adopt that one of the plans so submitted which shall in their judgment best meet the wants and requirements of the state; and they shall have the right to reject any and all plans submitted.

SEC. 5. The board shall allow as compensation for specifications. said plans and specifications and full working details, a sum not to exceed one per cent of the contract price of said building to be constructed; and upon the adopting of said plans, and the letting of the contract for the erection of said main building, the board shall certify the contract price, together with the amount allowed the architect, to the auditor of public accounts, who shall then draw his warrant on the general fund for one-half of one per cent on the contract price of said building, and the balance due upon the contract made by the board with the said architect for said plans and detail drawings shall be certified to by the board in installments as the work progresses, withholding sufficient amount until the completion of all of said detailed working plans, to insure the completion of the same. When they are completed, that fact shall be certified to the auditor, and he shall then draw his warrant on the general fund for the balance due the architect.

SEC. 6. The board within ten days after the adopting of plans and specifications, shall advertise for thirty days in three newspapers in the state of Nebraska, one in Chicago, Illinois, and one in St. Joseph, Missouri, for bids for the erecting of the main building of the said state house and the completion of the same in accordance with the plans and specifications adopted. specifications. SEC. 9. The board shall require a good and suf- Bond of ficient guarantee to accompany each bid, to the effect, that should the contract be awarded to the bidder, he will within twenty days from the awarding of said contract with the state for the erection of said main building, according to the advertisement and his bid, and that he will further give a good bond running to the State of Nebraska, in the sum of three hundred thousand dollars, to be approved by the governor; the bond conditioned for the faithful performance of his contract, according to law and terms thereof.

SEC. 10. The board shall reserve the right to reject Rejection of any and all bids, if in their judgment they are too high, or not in accordance with the law and the advertisement; and in that event they shall proceed to advertise as before until there is a favorable bid received by the board, Provided, That said board shall reject all bids for said main building for which the bid or bids be for the sum of four hundred and fifty thousand dollars or upwards, And it is hereby provided, That said board shall not expend any sum exceeding said sum of four hundred and fifty thousand dollars in the erection and full completion of said main capitol building.

SEC. 11. Immediately upon the awarding of the contract the board shall appoint a competent and prac. tical builder as superintendent of construction, whose duty it shall be to see that the plans and specifications of said building are faithfully carried out in construction by said contractor, and it is hereby made the special duty of the superintendent to see that the proper material is used in the construction of said building, and that all work is done in a skillful and workmanlike manner.

SEC. 12. It shall be the duty of the superintendent to make out and return to the board, monthly statcments, showing the amount of work done on said main building, and materials furnished by the contractor, and perform such other services, and give such other information from time to time, as the board may require. Such statements and information shall always be in writing and sworn to by the superintendent.

SEC. 13. The superintendent shall, before entering upon the discharge of his duty, enter into a good and sufficient bond to the State of Nebraska, in the sum of twenty-five thousand dollars, to be approved by the board, conditioned for the faithful performance of his duties as specified in this act.

SEC. 14. The superintendent shall be allowed such compensation as the board of public lands and buildings shall decide, not to exceeed two per cent on the contract price of said building, or of the work done on the same, under his supervision, which amount shall be certified by the board, and on such certificate the auditor of public accounts shall draw his warrant on the general fund of the state for said amounts, from time to time as the work progresses, not to exceed the rate of one thousand dollars per year for the actual time employed.

SEC. 15. During the progress of the construction of Monthly estisaid building, the superintendent shall make out and Warrants. file with the board, monthly estimates showing the amount of work done on said main building, and material furnished by the contractor, together with such other information from time to time, as the board may require him to give, and the board shall, after a careful examination of such estimate, if correct, certify the same to the auditor of public accounts, showing the amounts thus found due the contractor, and upon such certificates being thus presented to the auditor, he shall draw his warrant upon the special fund created for the erection of said building, in favor of the contractor, for eighty-five per cent of the amount thus certified by the board, and when the contract is completed, and the final estimate made, the board shall certify this fact to the auditor of public accounts, who shall then draw his warrant as before, including in the said last warrant the fifteen per cent retained, making the balance due the contractor upon his contract.

SEC. 16. It shall be the duty of the treasurer to pay said warrants so drawn whenever they are presented and there are sufficient funds in his hands belonging to the special fund of the state, from the levy made in accordance with the provisions of this act.
