CIRCULARS ISSUED BY THE COMMISSION.
CIRCULAR NO. 28.
TALLAHASSEE, Fla, May 10, 1890. The statute provides: “That it shall be the duty of the Railroad Commissioners to investigate the books and papers of all railroad companies doing business in this State, to ascertain if the rules and regulations of the Commission have been complied with, and to make personal visitations of the offices, stations and other places of business for the purpose of examination. Said Commissioners shall also have full power and authority to examine all agents and employes of said railroad companies and other persons under oath or otherwise, in order to procure the necessary information to make just and reasonable rates of freight and passenger tariffs, and to ascertain if their rules and regulations are observed or violated; and to make necessary rules and regulations concerning such examinations, which shall be obeyed and enforced, as the other rules and regulations provided for in said statuté. The law further provides that the Commissioners, in making any examination for the purpose of obtaining information pursuant to the statute, shall have power to issue subpænas for the attendance of witnessess, by such rules as they may prescribe. (Chapter 3746, sections 15 and 23, as amended by Chapter 3862, Laws of Florida.)
In pursuance of the requirements of the aforesaid statute, the following rules and regulations are hereby made and prescribed, to-wit:
1. In making any investigation or examination referred to in the statute, every reasonable facility shall be afforded the Com. mission by the railroad companies, its officers, agents and employes, whose books, papers, offices, stations or other places of business, shall be the subject of investigation or examination. (Chapter 3746, Section 24.)
2. In conducting any such investigation or examination, any officer, agent or employe of the railroad company, or other person, may, in the discretion of the Commissioners, be examined under oath or otherwise.
3. Subpænas for witnesses shall be signed by the Commissioners or by the commissioner appointed to make any such investigation, as the case may be ; shall designate the day, hour, place, the witnesses are required to attend, and if any books or papers are required to be produced, shall contain a description thereof. Subpenas shall be in the form as near as practicable, of those used in the Circuit Courts in this State, shall be placed in the hands of the Secretary of the Commission or the sheriff of the county in which the witness or witnesses may reside for immediate service, and to be returnable by such officer as soon as the same shall have been served, to the Commission with his return of the date and manner of service thereon; the manner of service to be the same as that required by law for a like service in said Circuit Courts. Notices, or other communications of the Commission may be served by mail.
4. Any such investigation or examination made outside of the office of the Commissioners anywhere in this State, may be made and conducted by any one of the Commissioners duly authorized and appointed by said Commissioners for that purpose, who shall be “invested with the same power as board would have, the Commissioner so appointed to report to a full board the result of his investigation.” (Chapter 3746, Section 23.)

TALLAHASSEE, FLA., June 12, 1890. Application having been made to the Commission for a re. vision of rates on all articles classed as fertilizers;
NOTICE IS HEREBY GIVEN.
That the Railroad Commissioners, will, at their office in Tallabassee, on Wednesday, the 9th day of July, 1890, revise the rates on fertilizers heretofore allowed the railroad companies within this State, including the prescribing the rates on phosphate rock, ground and bone phosphate, and phosphates of
Al railroad corporations doing business as common carriers, wholly or in part within this State, and all persons interested, are requested to be present on that day and to offer such facts and suggestions as will enable the Commission to prescribe
just and reasonable rates for the use of the railroads within this State, on said articles of freight.
When personal attendance is impracticable, written commu nications are solicited. By order of the Board,

2. Freight Rule No. 3, Circular No. 23, is amended so as to include the articles named above, and as amended will read as follows :
Rule 3. The rates specified or hereafter to be allowed for common brick, bone, lumber, shingles, laths, staves, rough stone, empty barrels, corn in the ear, melons by the car-load, straw, shucks, fodder, tan bark, saw dust, household goods, moss, palmetto leaves and heads, and phosphates, including phosphate rock, pebble phosphate, fossil bone phosphate, and soft or marl phosphate, are maximum rates, but the railroads are left free to reduce the same at discretion, and all such rates are exempt from the operation of Rule 2. Any complaint as to such rates, will, upon presentation, be considered. The Commission will entertain complaints of excessive charges for the transportation of such articles in all cases except where the price charged was according to contract between shipper and carrier.
3. Freight Rule No. 6, Circular No. 23, is amended so as to include Class T, and as amended will read as follows :
Rule 6. Shippers of articles in classes L, M, N, O, P, R, and T, may be required to pay the cost of loading and unloading.
4. Freight Rule No. 10 is amended by striking out the words, "lump and ground phosphates," and as amended will read as follows:
Rule 10. The term “ Fertilizers” embraces the following and like articles, when intended to be used as fertilizers, towit: Sulphate of ammonia, ashes, bone-black, ground and dissolved bone, bone dust, castor pomace, cotton seed meal,
cotton seed ashes, cotton seed, fish scrap, guano, superphosphates, gypsum, kainit, German salts, nitre-cake, nitrate and sulphate of soda, oil cake, potash, fine ground plaster, salt cake, salt petre, sulphur, and tank stuff.
5. The following have been fixed as the maximum rates to be charged by all railroad companies doing business wholly, or in part, within this State, for the transportation of articles embraced in Class T, to-wit:
