AN ACT to incorporate the St. Johns and Halifax Navigation and Improvement
Company.

WHEREAS, It is of the most important concern to the people of
this State that its internal commerce should be promoted, its
resources developed, and its natural revenues of intercommu-
nication improved, by means of liberal legislation; AND
WHEREAS, A wise public policy dictates the encouragement
and protection of private enterprise by judicious grants of
corporate rights, powers, and liabilities; AND WHEREAS, In
order to more fully effect the objects and accomplish the pur-
poses of such corporations, the bestowal of exclusive privi-
leges is often essential as a public necessity and convenience;
therefore,

SECTION 1. The people of the State of Florida, represented in Senate and Assembly, do enact as follows: That Abijah Giled with corpo- bert, Frederic A. Dockroy, Morris H. Alberger, John L. ReQua, Horatio Jenkins, Jr., William W. Ross, and A. R. Meek, and such other persons as may become associated with them by becoming stockholders in said corporation, their successors and assigns, are hereby created a body corporate and politic, by the name and style of "The St. Johns and Halifax Navigation and Improvement Company," with all the rights and powers conferred, and liabilities prescribed by An At entitled An Act to Provide for the Creation of Corporations and to Prescribe their General Powers and Liabilities, approved A. D. 1868.

SEC. 2. Be it further enacted, That the capital stock of said company shall be two hundred and fifty thousand dollars, to be divided into shares of one hundred dollars each.

SEC. 3. Be it further enacted, That the said company, or corporation, shall have the exclusive right of connecting the waters of the St. Johns river by the way of Julington Creek with the waters of North river, and the water of Mantanzas river with the head-waters of Halifax river, by a series of canals, so as to make an inland steamboat navigation from Jacksonville, by the way of St. Augustine, with Halifax river. ject, the said company shall have the right to improve any of the said rivers, creeks, inlets, or lagoons, by dredging, canalling, or making cut-offs, and to construct any lock or locks, dams or embankments, and to erect such other work or works as they may deem necessary for making, repairing, or keeping in repair any of such works which may be necessary to complete and perfect such inland navigation.

SEC. 4. Be it further enacted, That there is hereby granted to the said company, by and with the consent of the Board of Trustees of the Internal Improvement Fund of Florida, the right Right of way. of way through all lands owned by the State, and the title in fee simple to lands for four hundred feet on each side of any of the canals cut or streams improved, as well as the title to all lands that may be given to the State of Florida by the government of the United States to aid in any of the improvements contemplated by this act; and the Board of Trustees of the Internal Improvement Fund are authorized to make such other concessions of lands to the said company, to aid in the completion of said improvements, as they may deem for the best interest of the State. SEC. 5. Be it further enacted, That the president and directors of said company shall be authorized to agree upon such rates of tolls for the use of such navigation as they deem reasonable, and as shall be approved by the Board of Trustees of the Internal Improvement Fund; and the said company may collect tolls on all vessels or other water craft which may pass or repass through any canal which said corporation may cut or construct, or that may pass or repass through any channel they may have dredged or deepened, and said company shall be entitled to demand and receive said tolls upon all produce, merchandise, goods, or other articles which may be transported through any of the canals cut or waters improved by the said company; and all produce, goods, merchandise, boats, or other articles or things which may be transported or conveyed through any of said canals constructed or waters made navigable, shall be liable for the tolls and fees for which they are respectively chargeable, and may be detained until the same be paid and acquitted.

SEC. 6. Be it further enacted, That the said company shall cause to be surveyed the route of its proposed canal or canals within one year from and after the passage of this act; and shall construct and open the proposed connection between Julington Creek and North river within three years from and after the passage of this act; otherwise all the rights and powers conferred upon said company by this act of incorporation shall become void and inoperative.

AN ACT to incorporate the Suwannee Steamboat Company.

WHEREAS, Serious obstructions exist in the Suwannee river, placed there during the late war, which renders the navigation of said river above Clay's Landing exceedingly difficult and impracticable; AND WHEREAS, It is the intention of the persons. named in this act of incorporation to remove said obstructions, and to improve and render useful for the public good the navigation of said river above Clay's Landing; AND WHEREAS, It is injurious to the interests of the State to prevent, embarrass, or paralyze the efforts of the people in aid of the internal improvement of the State, but a matter of wise legislation to foster and protect private enterprise in such direction:

SECTION 1. The people of the State of Florida, represented in Senate and Assembly, do enact as follows: That Washington Rogers, George W. Rogers, Peter Moran, and John A. Boyd, citizens of the State of Florida, and such persons as are associated with them, or as hereafter may be associated with them,. their successors and assigns, shall be, and are hereby, created, constituted, and declared a body corporate and politic, by the name of the Suwannee Steamboat Company, and by that name they and their successors may and shall have succession for a period or term of twenty years, with the right and use of a common seal, and shall be capable of suing and being sued, pleading and being impleaded, in all places and courts whatsoever, and may hold, possess, acquire, and enjoy real and personal estate, and by virtue of this act, as delegated to the said company, all the legal powers, duties, and obligations appertaining to such corporations.

SEC. 2. That said company is empowered to elect such officers as they may require, and perform such duties, not inconsistent with the laws of this State, or of the United States, as a majority of said company may deem proper.

SEC. 3. That the capital stock of said company shall be ten thousand dollars, with the privilege to increase to fifty, divided into shares of one hundred dollars each, with privilege of building, owning, or possessing such steamboats and towboats as may be necessary to transport the freight and produce on the Suwannee river between Cedar Keys and Columbus.

SEC. 4. That the State of Florida hereby grants unto the said Exclusive company, and their successors in office, during the existence of this charter, the exclusive privilege of navigating the Suwannee river above Clay's Landing to Columbus, in Suwannee county.

SEC. 8. That this act shall be in force from and after the passage thereof.

AN ACT to incorporate the Jacksonville Hotel Company.

The people of the State of Florida, represented in Senate and Assembly, do enact as follows: SECTION 1. That Oscar E. Austin, John Clark, Otis L. Keene, Thomas O. Holmes, and John S. Driggs be, and they are hereby, incorporated in the name and rate powers. style of the Jacksonville Hotel Company, located in the city of Jacksonville, Duval county, Florida."

SEC. 2. That Oscar E. Austin, John Clark, Otis L. Keene, Thomas O. Holmes, and John S. Driggs, are hereby appointed commissioners authorized and empowered to open the books of said company for subscription to the capital stock thereof at Jacksonville, Duval county, and Palatka in Putnam county, and that they or any one of them are authorized and empowered to receive the said subscriptions, and to receive from the subscribers to the capital stock of said company twenty-five per cent. of the amount by them subscribed.
